Minutes for the
January 20, 2005 Meeting

The Zoning Board of Appeals January 20, 2005 meeting was postponed until Monday, January 24, 2005 because of inclement weather.

Present at this meeting was Chairman Al Schutte, Members Lynn Watts and Lynn McCarthy and Pam Morin, Building Department.  Members Tom Lippert and Mike Reed were absent.

The following request was heard:

1.      Dina Lanham, 2892 Stanwin Place
        Request for a variance from Section 1266.11(a)(3) of the Evendale Zoning code, prohibiting fences in the front yard in the Residential District.

This house has two front yards because it sits on a corner lot along Stanwin Place and Acton Court.  Dina Lanham has requested a building permit to put up a fence along Stanwin Place.

Ms. Lanham explained that their back yard is narrow with two concrete patios and a shed, limiting the amount of grassy area in the back.  They have a toddler and two dogs.  They are hoping to install a fence, because recently one of their dogs got loose and was hit by a car.  They have tried retaining their dogs with an invisible fence, but with no luck.  There are honeysuckle bushes and locust trees along the lot line where Ms. Lanham has proposed to put the split rail fence.  .

Notification of the meeting was sent to all adjoining neighbors.  Though many of the neighbors came in to examine the plans, no one expressed any concerns.

The committee discussed the six justifications for granting a variance.  Al Schutte agreed that the fence may be hidden with the bushes and trees now, but vegetation is not permanent and at some point the fence may become visible.

Al Schutte made a motion to deny the variance because justification #3 was not met.   Lynn McCarthy seconded the motion.  The motion passed with the vote of 3 – 0.

2.      Approval of the minutes December 6, 2004 meeting.

Lynn McCarthy made a motion to approve the minutes with one minor correction.  Al Schutte seconded the motion.  The motion passes with a vote of 3 – 0.

3.      Updating the Zoning Code

Al Schutte mentioned that Jack Cameron, Assistant to the Mayor, had got one copy of both Sharonville and Blue Ash zoning codes.  Al plans to review the code and report back to the committee how the surrounding communities handle certain issues in the code, i.e. justifications for variance, maximum building coverage in different zones.
